Form an Indian entity first

Five steps before anyone works
01

Decide the structure — shareholding, capital, resident director

02

Incorporate with the ROC — a private limited company

03

PAN, TAN, GST and the funds — EPFO, ESIC and state professional tax

04

Open the bank account — and complete the FDI reporting

05

Then hire — appointment letters to the applicable code, payroll

Hire through an Employer of Record

Three steps, no entity required
01

Scope the roles — checked against local labour law

02

Issue the contracts — in the local instrument and language

03

Enrol and start — your people are working

Not either-or Many clients run both: the team starts under our Employer of Record while the India entity is formed in parallel, then the staff transfer across with continuity of service preserved.

Local context

Employing in India: what actually governs it

India consolidated twenty-nine central labour statutes into four codes — on wages, industrial relations, social security, and occupational safety and working conditions — which came into force on 21 November 2025. Central rules and the state rules that give them practical effect continue to be notified, so the operative position is partly national and partly the state in which your employee sits.

An employer registers with the Employees Provident Fund Organisation (EPFO) and, where the wage threshold applies, with the Employees State Insurance Corporation (ESIC). Tax is deducted at source under the employer TAN and remitted monthly, and professional tax is a state-level obligation with its own registration and rates.

Why the state matters as much as the country

Employment conditions, professional tax and the Shops and Establishments regime are set at state level. A team split between Noida, Bengaluru and Mumbai is three sets of obligations, not one — which is the single most common surprise for a foreign employer entering India.

  • We hold the employment relationship; you direct the work.
  • No private limited company, no resident director, no ROC filings for you.
  • Procurement and freight out of India available on the same agreement.

The labour codes came into force in November 2025 and state rules continue to be notified. We confirm the position in your state before you commit to terms or a start date.

Why Horizon

India is a second sourcing base as well as a workforce

Most groups arrive in India for one of two reasons: people, or supply. We run both from Noida, and carry India through workforce, procurement and freight on one agreement.

Noida, in the Delhi capital region

Our office sits in the industrial and services belt around Delhi, within reach of the authorities, the manufacturers and the airport.

Four labour codes, still bedding in

The codes came into force in November 2025 and state rules continue to be notified. We work to the position as it currently stands in your state, and confirm it before you commit.

People and cargo on the same file

The team we employ for you and the goods we source for you are managed by the same office, which is why clients consolidate here.

Common questions

Employer of Record in India

Can we hire in India without setting up a company?

Yes. We employ the person through our Indian arrangement, which already carries the statutory registrations, so you avoid incorporating a private limited company, appointing a resident director and filing with the Registrar of Companies.

Which law applies now that the labour codes are in force?

The four labour codes took effect on 21 November 2025 and the state rules that operationalise them continue to be notified. We work to the position as it currently stands in the state where your employee will sit, and confirm it before you commit to terms.

Does the state my employee works in change anything?

Considerably. Professional tax, the Shops and Establishments regime and several conditions of employment are set at state level. A team across three states is three sets of obligations, which we administer separately and report to you together.

What are the current EPFO and ESIC contribution rates?

They are set by regulation and revised from time to time, and the ESIC obligation depends on a wage threshold. We confirm the rates and thresholds applicable to your salary levels as part of the quote rather than publishing figures that may be out of date.

Can you sponsor employment visas for foreign staff?

Yes, for staff employed through us. The employment visa category has its own conditions on role and remuneration, and there are registration formalities after arrival that we handle.

Can you also source and ship goods out of India?

Yes, and it is the reason clients consolidate here. Our Noida office runs procurement, quality inspection and freight alongside employment, so the team and the cargo are managed on one file.

Begin with the objective. We will map the route.

Tell us where in India the people will sit and what they will do. We return the employment route, the state-level obligations that follow and the sequence.
